Welcome to WaltzDarling Photography. This page explains the terms that apply when you book my photography services, as well as how I collect, use and protect personal information.
Terms & Conditions
1. About WaltzDarling
WaltzDarling Photography (“WaltzDarling”, “I”, “me” or “my”) is a photography studio based in Rotterdam, the Netherlands.
These Terms & Conditions apply to photography services booked with WaltzDarling and, where relevant, to the use of www.waltzdarlingphoto.com.
The details of each booking — including photography coverage, date, location, price and delivery — will be set out in the quotation or Photography Agreement.
If a signed Photography Agreement contains terms that differ from these general Terms & Conditions, the Photography Agreement will take precedence, subject to applicable law.
2. Photography services
WaltzDarling provides professional photography services including weddings, elopements and couple photography.
My work has a warm, romantic and artful approach, combining documentary observation with gentle direction where needed.
Every wedding and session is different. By booking WaltzDarling, you acknowledge that the photographs will reflect my artistic style and the circumstances of the day, including light, weather, location and the natural way events unfold.
3. Booking
A booking is confirmed once the booking requirements stated in your quotation or Photography Agreement have been completed.
A booking fee may be required to reserve your date. Once confirmed, that date is held specifically for you and may no longer be offered to another client.
The amount of the booking fee and the remaining payment schedule will be clearly communicated before booking.
The remaining balance must be paid by the date stated on the invoice or in the Photography Agreement.
Additional costs such as agreed travel or accommodation expenses will always be communicated in advance where applicable.
4. Cancellation & rescheduling
Cancellations and requests to reschedule must be made in writing.
Because wedding dates are often reserved far in advance, the booking fee is generally non-refundable once applicable law allows this.
Any further cancellation charges will be stated in the Photography Agreement and will take into account the timing and circumstances of the cancellation.
Requests to move a booking to another date are subject to availability. I will always try to accommodate a new date where reasonably possible.
If I am not available on the newly requested date, the change may be treated as a cancellation.
Nothing in these terms limits any mandatory consumer rights available under Dutch or European law.
Where a statutory cooling-off period applies to an online booking, the applicable legal rules will be respected. Services reserved for a specific date may be exempt from such a cooling-off period under applicable law.
5. If I am unable to attend
In the unlikely event that I am unable to photograph your wedding or session due to serious illness, accident or circumstances beyond my reasonable control, I will contact you as soon as reasonably possible.
Where appropriate, I may help arrange a suitable professional replacement in consultation with you.
If no appropriate replacement can be arranged and I am unable to provide the agreed service, payments relating to services that cannot be provided will be refunded in accordance with the Photography Agreement and applicable law.
6. The wedding day
You are responsible for providing accurate information regarding dates, locations, schedules and other details that may affect the photography.
You are also responsible for ensuring that photography is permitted at your chosen ceremony, venue and other locations unless we have agreed otherwise.
Wedding days are naturally unpredictable. Weather, lighting, delays, venue restrictions, ceremony rules, guests and other circumstances may affect what can be photographed.
I welcome information about particularly important people, details or traditions, but I cannot guarantee that every individual moment or requested photograph will be captured.
My aim is to allow you to remain present in your day rather than turning it into a continuous photoshoot.
7. Other photographers & suppliers
I am happy to work alongside videographers, planners, content creators and other professionals.
However, WaltzDarling cannot be held responsible for photographs that are missed or affected because another photographer, supplier, guest or third party obstructs or materially interferes with the photography.
8. Artistic approach
By booking WaltzDarling, you acknowledge that you are familiar with and appreciate the photographic and editing style shown throughout my portfolio.
The selection of photographs included in the final gallery is made at my professional and artistic discretion.
Every delivered photograph is individually selected and edited. Editing may include adjustments to light, colour, contrast, crop and other visual elements consistent with the WaltzDarling aesthetic.
RAW files and otherwise unfinished or unedited photographs are not delivered.
Requests for substantial additional retouching beyond my normal editing process may be subject to an additional fee.
9. Delivery
Your estimated delivery timeframe will be communicated at the time of booking or stated in your Photography Agreement.
Unless expressly agreed otherwise, delivery dates are estimates.
After delivery, you are responsible for downloading and safely backing up your photographs.
I take reasonable care in storing and backing up photographs throughout my workflow, but cannot guarantee indefinite archival storage after the final gallery has been delivered.
10. Copyright
Copyright in photographs created by WaltzDarling remains with the photographer unless explicitly agreed otherwise in writing.
Clients receive a personal, non-commercial licence to enjoy, download, print and share their delivered photographs.
Photographs may not be sold, used for advertising, transferred to businesses for commercial purposes or substantially altered without prior written permission.
Wedding venues, planners, florists, designers and other suppliers who wish to use photographs for their own business or marketing should contact WaltzDarling separately regarding permission and licensing.
11. Portfolio & publication
Your privacy matters to me.
Booking WaltzDarling does not by itself mean that you automatically give unrestricted permission for recognisable photographs of you to be used publicly.
Where permission is required for photographs to be shared through my portfolio, website, social media, publications, exhibitions, competitions or other promotional channels, this will be addressed separately in the Photography Agreement or through another clear consent request.
Where publication is based on consent, you may withdraw that consent in accordance with applicable privacy law. Withdrawal does not make earlier lawful use unlawful.
I approach photographs of clients and their guests with care and respect.
12. Liability
I take reasonable professional care when photographing, handling, backing up and delivering photographs.
However, photography is influenced by circumstances that cannot always be controlled, including weather, available light, venue restrictions, delays, guests, other suppliers and unforeseen technical problems.
In the unlikely event that photographs are permanently lost, damaged or corrupted because of technical failure, any remedy will be proportionate to the affected part of the photography service.
Nothing in these Terms & Conditions excludes or limits liability where doing so would not be permitted under applicable law.
13. Force majeure
Neither you nor WaltzDarling will be held responsible for failure to fulfil an obligation where this becomes impossible or unreasonable because of exceptional circumstances genuinely beyond that party’s reasonable control.
This may include serious illness, accidents, natural disasters, extreme weather, government restrictions or major transport disruption.
If such circumstances affect your booking, we will make reasonable efforts to find a fair and practical solution.
14. Questions or complaints
If something about my service has not met your expectations, please contact me as soon as possible.
I value open communication and will always aim to understand the situation and find a reasonable solution.

15. Governing law
These Terms & Conditions and photography agreements with WaltzDarling are governed by Dutch law.
Any disputes will be handled by the competent court in accordance with applicable Dutch and European rules concerning jurisdiction and consumer protection.
Privacy Policy
16. Your privacy
WaltzDarling respects your privacy and handles personal information with care.
This Privacy Policy explains what information I may collect, why I need it, how it may be used and what rights you have in relation to your personal data.
Personal data is processed in accordance with the General Data Protection Regulation (GDPR / AVG) and other applicable privacy legislation.
17. Information I may collect
Depending on how you interact with WaltzDarling, I may process information such as:
your name
email address
telephone number
billing or address information
wedding or session date and location
information you provide through an enquiry or contact form
correspondence between us
booking, contract and invoice information
photographs and other visual material created as part of my services
technical website information, such as browser or device information, where collected through cookies or analytics
I only collect information that is reasonably necessary for the purpose for which it is being used.
18. Why I use your information
Personal information may be used to:
respond to enquiries
prepare quotations and photography agreements
manage and fulfil bookings
communicate before, during and after a wedding or session
provide and deliver photography services
deliver online galleries
process invoices and payments
maintain my business administration
comply with legal and tax obligations
maintain and improve the Website
protect my legitimate business interests
publish photographs where there is an appropriate legal basis to do so
I will not use personal information for an unrelated purpose without an appropriate legal basis.
19. Legal grounds
Depending on the circumstances, personal data may be processed because:
it is necessary to enter into or perform an agreement with you
I have a legal obligation
I have a legitimate business interest that does not override your privacy rights
you have given your consent
Where processing is based on consent, you may withdraw that consent at any time.
20. Photographs as personal data
Photographs in which a person can be identified may constitute personal data.
Photographs created during a wedding or session are processed where necessary to provide the photography service and, depending on the circumstances, on another appropriate legal basis.
Public use of recognisable photographs for marketing or portfolio purposes is treated separately from simply creating and delivering the photographs.
Where consent is the appropriate legal basis for public use, I will request that consent separately rather than treating acceptance of this Privacy Policy as permission to publish your photographs.
21. Sharing information
I do not sell your personal information.
Personal information may be shared with carefully selected service providers where this is reasonably necessary to run my business or provide your photography services.
These may include providers used for:
website hosting
email
online gallery delivery
cloud storage and backup
invoicing and accounting
payment processing
professional photography services
website analytics
Only the information necessary for the relevant service is shared.
Where required, appropriate agreements and safeguards are used when third parties process personal information on my behalf.
I may also disclose information where required by law.
22. International processing
Some technology and service providers may process or store information outside the European Economic Area.
Where this occurs, I will use providers and safeguards intended to ensure that personal data receives an appropriate level of protection in accordance with applicable privacy legislation.
23. How long information is kept
Personal information is not kept for longer than reasonably necessary for the purpose for which it was collected.
Different information may therefore have different retention periods.
For example:
enquiries that do not result in a booking may be deleted when they are no longer relevant
client communication may be retained for as long as reasonably necessary in connection with the photography service
contracts, invoices and financial administration may be retained for the period required under applicable tax and accounting law
photographs and delivered galleries may be retained for a reasonable period for delivery, backup and professional archive purposes
When information is no longer required, it will be deleted or anonymised where reasonably possible.
24. Cookies & analytics
The Website may use cookies and similar technologies.
Essential cookies may be used where necessary for the Website to function correctly.
Where analytics, marketing or other non-essential cookies are used and consent is legally required, they will only be activated after the appropriate consent has been obtained.
You can manage or withdraw cookie preferences through the available cookie settings where applicable.
25. Security
I take reasonable technical and organisational measures to protect personal information from loss, misuse, unauthorised access or disclosure.
No online or digital system can be guaranteed to be completely secure, but I take reasonable care in choosing the services and systems used within my photography business.
26. Your privacy rights
Depending on the circumstances, you may have the right to:
access the personal information I hold about you
correct inaccurate information
request deletion of your personal information
request restriction of processing
object to certain processing
receive certain personal information in a portable format
withdraw consent where processing is based on consent

You also have the right to submit a complaint to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) if you believe your personal information has been handled unlawfully.
27. Changes to this policy
This Terms & Privacy page may occasionally be updated to reflect changes in my services, Website or applicable law.
The most recent version will always be published on this page with its last updated date.
The terms applicable to an existing photography booking remain those agreed when the Photography Agreement was entered into, unless a later change is required by law or expressly agreed between us.
